Privacy Policy

This Privacy Policy explains how HiveLabs (SAGEFOUNTAIN Unipessoal LDA), operating as SwapHive, collects, uses, stores, shares and protects personal data when you use the SwapHive mobile application, website, services, features, support channels and related services. In this Privacy Policy, “SwapHive”, “we”, “us” or “our” means HiveLabs (SAGEFOUNTAIN Unipessoal LDA), a company incorporated in Portugal, with registered office at Maia, company/tax number 518938212. 1. About SwapHive

SwapHive is a digital platform that helps users discover, connect and communicate with other people who may have compatible collectible exchange interests. SwapHive does not own, sell, buy, authenticate, inspect, value, store, deliver, insure or guarantee any collectible item listed or exchanged by users. Users are responsible for the listings they create, the information they share, the people they choose to contact, the meetings they decide to attend and the swaps they choose to complete.

2. Personal data we collect

Account information: name, username, email address, phone number (if provided), date of birth or age range, password or authentication credentials, profile picture, account preferences, language preference, country/region, account creation date, account status, consent records, and parental or guardian consent information where applicable.

Profile and collectible information: profile description, collectible categories of interest, item names and descriptions, item photographs, item condition, item location or approximate exchange area, desired swap preferences, listing status and history, promoted listing status, package or feature usage, and ratings, feedback or reputation indicators where available.

Communications and messages: where SwapHive provides messaging, chat, offer, comment or contact features, we may collect messages sent and received, timestamps, participants, reports related to messages, moderation signals and safety-related metadata. We may access, review or process communications where reasonably necessary for safety, security, moderation, fraud prevention, legal compliance, dispute handling or enforcement of our Terms.

Location data: country, city, region or approximate location; user-selected location; listing location or preferred meeting area; device location if you grant permission; distance/proximity information; and IP-based approximate location. We do not recommend sharing your exact home address in listings or public profiles. Where precise device location is used, we will request your permission; you can disable location permissions at any time in your device settings, although some features may not work properly without them.

Payment and purchase information: if you purchase listing packages, promoted listings, subscriptions or other paid features, we may process the purchased product/package, price and currency, purchase date, transaction reference, app store or payment provider identifier, subscription status, renewal/cancellation/expiry status, refund/chargeback status, and invoice or tax information where applicable. Payments made through the Apple App Store, Google Play or other payment providers are processed by those providers; we do not receive or store your full payment card details when payment is handled by an app store or third-party payment provider.

Device, technical and usage data: device type, operating system, app version, device language, IP address, browser type where applicable, device or app instance identifiers, crash logs, diagnostic and performance data, feature usage, session activity, clicks, views and interactions, listing impressions, promoted listing performance, referral source, and fraud/abuse/security signals.

Reports, moderation and safety data: report reason, reported content, reporting and reported user, screenshots or evidence provided, moderation notes, enforcement actions, appeal information, safety investigation records, and records of suspicious, abusive, fraudulent or illegal behaviour.

Support and communications: your name, email address, support request details, attachments, communication history, feedback, complaint information and technical information needed to resolve the issue.

Information from third parties: Apple App Store or Google Play purchase confirmations; login or authentication providers if you use them; analytics, crash reporting or fraud prevention providers; moderation or safety tools; other users who report content or behaviour; and law enforcement or public authorities where applicable.

3. How we use personal data

We use personal data to provide and operate SwapHive (create and manage accounts, display profiles and listings, enable discovery, matching and messaging, manage listing packages and promoted listings, process purchases and subscriptions, provide support and maintain functionality); to support collectible discovery and swaps; to provide paid features; to improve and develop the service; to keep SwapHive safe and secure (detect and prevent fraud, scams, abuse, spam and misuse, investigate suspicious activity, moderate content, enforce our Terms, secure accounts, respond to reports and cooperate with lawful requests); to communicate with you (account notices, security alerts, service updates, purchase confirmations, support responses, policy updates and important safety notices, and, where permitted and with any required consent, marketing communications); and to comply with law and protect rights. SwapHive does not use this data to guarantee the authenticity, value, ownership, safety or legality of any item.

4. Legal bases for processing

Where the GDPR or similar laws apply, we rely on: Contract (to provide SwapHive under our Terms); Consent (e.g. certain location permissions, certain marketing, certain cookies/tracking, and parental/guardian consent where required — you may withdraw consent, without affecting prior processing); Legitimate interests (improving SwapHive, preventing fraud and abuse, maintaining safety and security, enforcing our Terms, moderating content, handling disputes, understanding product performance and protecting our business and users); Legal obligation (tax, accounting, consumer protection, platform compliance, data protection, safety or law enforcement obligations); and, in rare cases, vital or public interests in connection with serious safety concerns, emergencies or lawful authority requests.

5. Children and minors

SwapHive is not intended for children under 13. Users under 13 are not permitted to create an account or use SwapHive. Users aged 13 to 17 may only use SwapHive with the knowledge, consent and supervision of a parent or legal guardian. If you are a parent or legal guardian and allow a minor to use SwapHive, you are responsible for supervising that minor’s use, including listings, messages, meetings, interactions and any swaps. We may request confirmation of parental or guardian consent where required by law or where we consider it appropriate. We do not knowingly collect personal data from children under 13; if we become aware that a child under 13 has created an account or provided personal data, we will take reasonable steps to delete the account and related data, unless retention is required for safety, legal compliance, fraud prevention, investigation, protection of rights or cooperation with authorities. Users under 18 should not share their home address, school address, phone number, email address, social media profile or other sensitive personal information with other users, and must not arrange, attend or complete an in-person swap unless accompanied and supervised by a parent, legal guardian or responsible adult.

6. How we share personal data

We do not sell your personal data. We may share it with other users (username, profile picture, public profile information, listings, item photos and descriptions, general location or preferred exchange area, ratings/feedback where available, messages you send, and information you choose to share); with service providers that help us operate SwapHive (cloud hosting, databases, authentication, analytics, crash reporting, customer support, email delivery, payment infrastructure, app store billing, moderation and safety tools, fraud prevention, security monitoring, and legal/tax/accounting/professional services), who may only process data according to our instructions or as otherwise permitted by law; with app stores and payment providers for purchases; for safety, legal and enforcement reasons; and in connection with a business transfer (merger, acquisition, financing, restructuring, sale of assets or transfer of business), subject to appropriate safeguards.

7. International transfers

We may process and store personal data in countries other than your country of residence. Where personal data is transferred outside the European Economic Area, the United Kingdom or Switzerland, we will use appropriate safeguards where required by law, such as adequacy decisions, standard contractual clauses or other lawful transfer mechanisms.

8. Data retention

We keep personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. We may retain account data while your account is active; listing data while listings are active and for a reasonable period afterwards; transaction and purchase records for legal, tax, accounting and fraud prevention purposes; support communications for customer service and dispute handling; safety, moderation and enforcement records for as long as necessary to protect users, prevent abuse, comply with law or defend legal claims; and technical logs for security, diagnostics and service reliability. When data is no longer needed, we will delete, anonymise or securely retain it in accordance with applicable law.

9. Account deletion and data deletion

You may request deletion of your account through the app, or contact us at info@thehivelabs.eu. When you request account deletion, we will delete or anonymise personal data associated with your account, unless we need to retain certain data for legitimate or legal reasons, such as security, fraud prevention, abuse prevention, unresolved disputes, outstanding payments or refunds, tax/accounting/legal compliance, enforcement of our Terms, protection of users or third parties, cooperation with authorities, and the establishment, exercise or defence of legal claims. Deleting your account may remove your profile, active listings, messages and access to paid features. Some information may remain visible to other users where it was already shared with them, copied by them, included in their messages, or retained for safety or legal reasons. Temporary account deactivation does not equal account deletion.

10. Your privacy rights

Depending on your location and applicable law, you may have the right to access your personal data; correct inaccurate or incomplete data; delete your personal data; restrict processing; object to processing; withdraw consent; request portability; object to direct marketing; and lodge a complaint with a data protection authority. To exercise your rights, contact us at info@thehivelabs.eu. We may need to verify your identity before responding. If you are in Portugal, you may contact the Portuguese Data Protection Authority, Comissão Nacional de Proteção de Dados (CNPD).

11. Marketing communications

Where permitted by law, we may send you marketing communications about SwapHive features, updates, offers, listing packages, promoted listings, events or community news. You can opt out of marketing emails using the unsubscribe link or by contacting us. Even if you opt out of marketing, we may still send non-marketing messages, including account, security, legal, purchase, safety and service-related communications.

12. Cookies and similar technologies

If SwapHive operates a website, we may use cookies and similar technologies to operate the website, remember preferences, measure usage, improve performance, prevent fraud, support analytics and understand marketing effectiveness. Where required by law, we will request your consent before using non-essential cookies. You can manage cookies through your browser settings or any cookie management tool we make available.

13. Analytics and advertising

We may use analytics tools to understand how users interact with SwapHive and to improve the service. If we use advertising, attribution or marketing tools, we will do so in accordance with applicable law, platform rules and consent requirements. We do not knowingly use personal data of users under 18 for behavioural advertising, and we do not allow paid functionality to depend on granting unnecessary tracking, advertising or location permissions.

14. Security

We use reasonable technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, alteration, disclosure or destruction, including access controls, encryption in transit where appropriate, secure authentication, monitoring and logging, vulnerability management, data minimisation, restricted access to personal data and security reviews of service providers. No system is completely secure. You are responsible for keeping your login credentials confidential and for notifying us if you suspect unauthorised access to your account.

15. User responsibility for shared information

SwapHive allows users to publish listings and communicate with other users. You should not share unnecessary personal information in your profile, listings, item photos or messages. You should not publicly share your home address, school address, phone number, email address, financial information, identity documents, passwords, personal data of other people, or sensitive information that could put you at risk. You are responsible for the personal information you choose to share with other users.

16. Safety, reports and investigations

If you report another user, listing, message or incident, we may process the information you provide to assess the report and take appropriate action. If another user reports you, we may process information related to your account, listings, messages or behaviour to investigate. We may preserve relevant data where necessary to investigate safety issues, enforce our Terms, prevent abuse, protect users or comply with law. Where we believe there is a risk of harm, fraud, abuse, illegal activity or child safety concern, we may take action including account restriction, content removal, reporting to authorities or cooperation with law enforcement.

17. Third-party links and services

SwapHive may contain links to third-party websites, app stores, payment providers, maps, login services or other external services. This Privacy Policy does not apply to third-party services; their own privacy policies and terms apply. We are not responsible for the privacy practices, security or content of third-party services.

18. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Privacy Policy in the app or on our website, sending an email, displaying an in-app notice or updating the “Last updated” date. Your continued use of SwapHive after the updated Privacy Policy becomes effective means that you acknowledge the updated Privacy Policy.
